Abstract

In some ways, trauma-informed sentencing is an oxymoron. If a sanction intends to punish through incarceration, its very purpose is to traumatize the defendant with an experience so unpleasant as to promote both specific and general deterrence. However, prison sentences are criminogenic and traumagenic. Trauma-informed practices aim to reduce or minimize harms experienced by everyone involved, while also reducing crime.
