Abstract

This chapter explains that Article 7(2) of the 1995 UNIDROIT Convention is primarily concerned with indigenous restitution claims. It details the development of approaches to identifying indigenous peoples and defining indigenous cultural objects, and notes how indigenous communities suffer from the UNIDROIT Convention’s lack of retroactivity.
