Abstract

This fifth edition of Principles of Civil Litigation represents a changing of the guard; both David Bamford and I have taken a step back, and Rhys Aston has admirably filled the breach. Having said that, David’s work remains the foundation of this book, and his scholarship continues to constitute the vast majority of the content of the book. However, in terms of updating and revising that content, and in some cases quite substantially, Rhys has shouldered that burden for all chapters other than chapters 10, 11, 14 and 17 – any errors in those four chapters remain my responsibility. Rhys has also written a new Chapter 1, “Introduction: Conceptualising Civil Justice”, that builds on the previous introduction in order to provide a jurisprudential frame for what is to follow. We have endeavoured to present the law as it existed in March 2024.

In terms of the book’s scope and aims, this fifth edition of Principles of Civil Litigation builds upon the foundation of the four previous editions. As with previous editions, the emphasis is on the principles of civil litigation, rather than applied civil procedure, although practice- oriented discussions occur when necessary to illustrate a theoretical point. Where appropriate, comment is also made concerning possible future directions and reform agendas for both civil litigation and the civil justice system.
