Abstract

In 2007 in a short essay contributed to a book titled Law and Liberty in the War on Terror, Phillip Ruddock, former Australian Minister for Immigration, quoted Sir John Latham, a former Commonwealth Attorney-General, who he says ‘liked to quote Oliver Cromwell’s statement on security matters that “being comes before well-being”’ (quoted in Ruddock 2007: 3). In echoing the very essence of biopolitical governance he says ‘the necessary premise of any constitutional order and system of government is that people are alive. Serious threats to national security must be addressed...
